1. Acceptance of the Terms of Use The following terms and conditions (collectively, these ā€œTerms of Useā€) apply to your use of www.openscied.org (the ā€œWebsiteā€), including any content, functionality and services offered on the Website. The Terms of Service also include the OpenSciEd Privacy Policy.

Please read the Terms of Use carefully before you start using the website, because by using the Website you accept and agree to be bound and abide by these Terms of Use. Should you disagree with some of the provisions herein, you can either leave the Website or contact us at info@openscied.org.

OpenSciEd is committed to creating classrooms where teachers can fulfill their highest aspirations and where students can achieve more than they think possible. It is for this reason that we make our publications, resources, presentations, learning tools, professional development tools, and collection of student work freely available to users.

2. Changes to the Terms of Use and the Website

We reserve the right to update the Website and these Terms of Use from time to time, at our discretion and without notice. Your continued use of the Website following the publishing of updated Terms of Use means that you accept and agree to the changes.

3. Accessing the Website, Security and Privacy

We canā€™t guarantee that the Website will be up and running at all times. We reserve the right to suspend or restrict access to some features to users. In any case, we will not be liable if for any reason all or any part of the Website is unavailable at any time or for any period, nor for any data loss.

To access certain features of the Website you have to register by entering your email and choosing a password as part of our security procedures. You may use the Website without registration, but in order to take advantage of certain aspects, you may need to register for an account. Your account is for your sole, personal use. OpenSciEd website content, including the classroom curriculum and professional learning resources created by OpenSciEd and its partners, are licensed under a Creative Commons Attribution 4.0 International License (CC BY 4.0) or Creative Commons NonCommercial Plus 4.0 International License. By accessing, downloading, or distributing the OpenSciEd materials, you agree to abide by the applicable license.Ā 

OpenSciEdā€™s name, brand, and trademarks cannot be used in conjunction with any commercial marketing or distribution of products or services without prior agreement from OpenSciEd and The National Center for Civic Innovation.

You may not use any automated means to manipulate the Website or attempt to exceed the limited authorization and access granted to you under this Terms of Use. You may not resell use or access to the Website to any third party.

5. Individual Features and Services

When using the Website, you will be subject to any additional posted guidelines or rules applicable to specific services and features that may be posted from time to time.

6. Disclaimers of Warranty, Limitations of Liability and Indemnification

Your use of the Website is at your sole risk. The service is provided ā€œas isā€ and ā€œas availableā€. We disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. 9. Governing Law and Jurisdiction

These Terms of Use and any dispute or claim arising out of, or related to them, shall be governed by and construed in accordance with the internal laws of the State of New York without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action or proceeding arising out of, or related to, these Terms of Use or the Website shall be instituted exclusively in the federal courts of the United States or the courts of the State of New York.

    • This permission is used to read and write to forms in your Google drive. The Bulk Downloader will only interact with forms as you direct them to.
    • View and manage the files in your Google Drive
    • This permission is used to create and manage files and folders. The Bulk Downloader will only interact with files as you direct them to.
    • Send email as you
    • The Bulk Downloader will only send an email as you direct them to.
    • Connect to an external service
    • The Bulk Downloader interacts with external APIs, which is used to enhance the features of the Bulk Downloader.
    • Allow this application to run when you are not present
    • The Bulk Downloader allows users to set time triggers, which kicks off a job at a specific time. This permission is necessary to enable this process.

        1. This permission is used to create and manage files and folders. The Google Classroom Uploader will only interact with files as you direct them to.

        1. The Google Classroom Uploader will only send an email as you direct them to.
      6. See, edit and create classroom materials in Google Classroom
        1. This is the main benefit of the Google Classroom Uploader. Assignments will be automatically drafted in your Google Classroom for you to edit and then choose to assign. 
        2. The Google Classroom Uploader will load assignments and documents as drafts to your new class. You will have the choice to assign them to your own classes and/or edit them. 
        3. The Google Classroom Uploader will create a new class in your Google Classroom. You are free to edit and delete the class as you see fit. 
      7. Connect to an external service
        1. The Google Classroom Uploader interacts with external APIs, which is used to enhance the features of the Google Classroom Uploader.

Please read these Terms of Service (ā€œTermsā€, ā€œTerms of Serviceā€) carefully before completing the OpenSciEd event registration (the ā€œServiceā€) operated by OpenSciEd (ā€œusā€, ā€œweā€, or ā€œourā€).

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Service.

Purchases

If you wish to purchase any service made available through the Service (ā€œPurchaseā€), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.

The service may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.

We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

Cancellations

In the event of a cancellation, our refund policy is as follows:

  1. 100% refund if OpenSciEd must cancel.
  2. For cancellations by participant(s) before the registration deadline, we will provide a full refund or funds can be applied to another OpenSciEd event.
  3. For cancellations by participant(s) after the registration deadline, up to 5 days before the event we will provide a 50% refund.
  4. No refunds will be provided for cancellations made 4 or fewer days before the event. 

Availability, Errors and Inaccuracies

We are constantly updating service offerings on the Service. We may experience delays in updating information on the Service and in our advertising on other web sites. The information found on the Service may contain errors or inaccuracies and may not be complete or current. Services may be mispriced, described inaccurately, or unavailable on the Service and we cannot guarantee the accuracy or completeness of any information found on the Service.

We therefore reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

Accounts

When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You acknowledge and agree that OpenSciEd shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third party web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third party web sites or services that you visit.

Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Governing Law

These Terms shall be governed and construed in accordance with the laws of New York, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

Consent to Use of Photographic Images

Registration and attendance at, or participation in OpenSciEd professional learning and other activities constitutes an agreement by the registrant to allow OpenSciEd and third-party organizations to use and distribute (both now and in the future) the registrantā€™s or attendeeā€™s image or voice in photographs, video, electronic reproductions, and/or audio recordings of such events and activities.

Force Majeure

The performance of the workshops is subject to termination without liability upon the occurrence of any circumstance beyond the control of either party ā€“ such as acts of God, war, government regulations, disaster, pandemics, strikes (except those involving employees or agents of the party seeking the protection of this clause), civil disorder, or curtailment of transportation facilities ā€“ to the extent that such circumstances makes it illegal or impossible to conduct the conference. The ability to terminate this agreement without liability pursuant to this paragraph is conditioned upon delivery of written notice to the other party setting for the basis for such termination as soon as reasonably practical ā€“ but in no event longer than ten (10) days ā€“ after learning of such basis.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
